Music Commission Terms of Service

The official email address for commission correspondence is kasran.fox@gmail.com. Commission details may be discussed elsewhere, but it is recommended that all official correspondence, including final commission information and change requests, be done via email through this address.

The terms of service listed below apply to all music commissioned from Kasran. Terms of service are subject to revisions, updates, and edits at any time without notification. BY SENDING PAYMENT, YOU (THE COMMISSIONER) AGREE TO ABIDE BY THE FOLLOWING TERMS AND CONDITIONS.

1. Prices

Advertised prices are subject to change at the artist's discretion according to complexity and other factors. Pricing will be discussed up front.

2. Slots

Commission slots are announced on the @bakphooon Twitter account. To claim a slot, send an email to the official address (listed above) with the information requested in the commission advertisement. By requesting a slot, the commissioner indicates that they have the funds to pay for the artwork in question and agrees to abide by the terms of service in this document. Limit is one slot per commissioner per round of commissions.

3. Communications

All descriptions and request details are due before work may begin. These should be supplied to the official email address listed above. The artist may request input or further references after work has begun, at their own discretion.

4. Permission from third parties

If the commission is a remix, arragement, or variant of another musician's work, written permission from that musician is required before work may begin.

5. Payment

Payment for the commission is due in full before work begins. Payment will be requested via emailed PayPal invoice, payable through PayPal or with a credit card.

6. Order of commissions

The order of completion of a round of commissions is not guaranteed. All commissions within a given round will be completed before another round is opened. I will do my best to complete time-sensitive commissions early in the queue, but this is not a guarantee.

7. Works in progress

Work-in-progress renders of commissioned music will not be made available for feedback from the commissioner until work is completed. However, if the work is done on stream, the commissioner is welcome to attend and ask for changes during the process. Requested changes will be applied at the discretion of the artist. The artist reserves the right to charge an additional fee for edits to the work.

8. Communication expected at checkpoints

Once a slot has been reserved, at any time that communication is required, the artist will wait 7 days for communication before continuing. In the event that payment has not been sent, this will mean the cancellation of the slot. In the event that payment has been sent, the artist will either refund the commission and cancel the slot, or finish the commission with the information that they have.

For timed work, initial details are due within 24 hours of reserving a slot. If the details cannot be worked out (any questions answered, permission from 3rd parties, and payment sent) within 7 days of the slot being reserved, the slot will be canceled.

9. Additional input

The artist may request critiques from the commissioner, colleagues, or livestream viewers during the creation of the work. These critiques may be implemented or rejected at the artist's discretion.

10. Turnover time

Anticipated turnover time for a commission is 1-3 weeks after payment is received. This may vary based on life circumstances, communication, complexity of commissions in the queue, and other factors. If a commission takes longer than 2 months, the commissioner is entitled to cancel the commission and receive a full refund.

11. Declining commissions

The artist reserves the right to refuse any commission for any reason.

12. Cancellation by artist

The artist reserves the right to refund the commissioner in full and cancel the commission at any time for any reason.

13. Cancellation by commissioner

The commissioner may terminate the commission at any time for any reason. If work has not yet begun, the commissioner will be refunded in full. If work has begun on the piece, the commissioner may receive a partial refund at the artist's discretion. The artist may supply the commissioner with an incomplete or earlier stage of the work at the artist's discretion.

14. Age and legality

By submitting an application, the commissioner attests that they are over the age of 18, and that the content they are commissioning is not illegal in their local jurisdiction. Failure to conform to this requirement, if discovered, will be treated as cancellation by the commissioner.

15. Distribution of completed work

Upon completion of the work, the artist will deliver the completed music in lossless FLAC and lossy MP3 formats to the commissioner. It is the commissioner's responsibility to distribute the file to any other parties involved in the commission.

16. Artist's display rights

The artist reserves the right to post the music to any personal website, blog, gallery, journal, or portfolio. Special arrangements may be made for the release to be delayed; these arrangements must be specified up front as part of the commission details.

17. Artist's rights over the work

The artist retains ALL rights to the commissioned music, including the right to extend it and to include it on albums or other releases. Rights to the work may be negotiated for a fee.

18. Client's rights

The client may copy and distribute the work for noncommercial personal use as they see fit, with credit to the artist. The client also has the right to remix or otherwise alter the work, as long as the altered work is used noncommercially and the original artist is credited. The client cannot use the work or any remix or alteration thereof to imply endorsement by the artist.

Commercial rights over the original work or over remixes of the work may be negotiated on a case-by-case basis for an additional fee.

19. Acceptance of TOS

The commissioner must read, understand, and accept all of the above terms and conditions before entering into an agreement with the artist. By sending payment, the commissioner agrees to abide by the above terms and conditions.
